SC bench disbands after Qazi Faez Isa’s counsel raises objection
ISLAMABAD: A Supreme Court bench, which was constituted to hear petitions concerning presidential reference against Justice Qazi Faez Isa, has been dissolved.
The petition is being heard by a seven-member larger bench, under the chairmanship of Justice Umar Atta Bandial, while others include Justice Maqbool Baqar, Justice Manzoor Ahmed Malik, Justice Sardar Tariq Masood, Justice Faisal Arab, Justice Ijazul Ahsan and Justice Mazhar Alam Khan Miankhel.
The bench was dissolved upon objections by Faez Isa’s counsel Munir A. Malik, who contended that some of the judges of the case were disagreeing to hear the case.
Malik requested that a full-court bench must be formed after excluding members of the Supreme Judicial Council.
He said judges who have their interests in the matter should not be part of the bench.
After Munir A Malik’s argument, the Supreme Court bench was dissolved and the request for the new bench was sent to the Chief Justice of Pakistan.
Justice Faisal Arab said the Supreme Judicial Council will continue its proceedings if Munir A Malik failed to prove his point.
Justice Tariq Masooq said he had already made his mind to not become part of the bench. Justice Ijazul Ahsan said he is also distancing himself to fulfil the requirements of justice.
